Terms of Service

1. Purpose

These Terms of Service govern access to and use of the Periscop platform, published by Ergopix Sàrl.

2. Description of the service

Periscop is a SaaS tool for measuring brand visibility in generative AIs and AI overviews of search engines. It queries third-party services (OpenAI, Anthropic, Google, Mistral, Perplexity, DataForSEO) and analyzes the responses obtained.

3. Access to the service

Access to the service is open upon creation of an account via the platform, where applicable after obtaining an invitation code. The user undertakes to provide accurate information and to preserve the confidentiality of their login credentials. Use of the service gives rise to the consumption of credits according to the pricing grid published on the site.

4. Intellectual property

The Periscop platform, its code, its interface, its brand and its visual identity remain the exclusive property of Ergopix Sàrl. Use of the service grants a personal, non-exclusive right of use, without transfer of ownership. Data and content provided by the customer remain their property.

5. Availability of the service

Ergopix takes reasonable means to ensure the availability of the service, without however guaranteeing uninterrupted operation. The service may be temporarily suspended, notably for maintenance or for reasons beyond Ergopix's control.

6. Liability

Periscop does not guarantee the completeness or accuracy of the analyses: results depend on the responses provided by third-party AI services, over which Ergopix has no control. Ergopix's liability cannot be engaged for decisions made on the basis of these analyses.

7. Force majeure

Ergopix cannot be held liable for any breach resulting from a case of force majeure or events beyond its control, notably the unavailability or modification of third-party services used by the platform.

8. Data and confidentiality

Data processing is detailed in our privacy policy.

9. Termination

The customer may request termination of their account at any time. Data is deleted within 30 days of termination.

10. Changes to the Terms

Ergopix may modify these Terms. Users are informed of any substantial change; continued use of the service constitutes acceptance of the updated Terms.

11. Applicable law and jurisdiction

These Terms are governed by Swiss law. The exclusive jurisdiction is Vevey, Switzerland, subject to applicable mandatory provisions.
